The Foreclosure
The Foreclosure is an optional course at Bachelor level, offered to the students in the fourth year of study. Its aim is to familiarize the students with the instruments of civil procedure specific to the second phase of the civil process. The course aims to provide students with a general, schematic presentation of the legal mechanisms that characterize the common law procedure regulated mainly by Book V of the Code of Civil Procedure regarding the forced execution of court decisions and other enforceable titles. The course addresses, among other things: the modalities and forms of forced execution, the participants in the forced execution, the object of the forced execution, the procedural incidents that may occur during the forced execution, the appeal against the execution, as well as the procedure for returning the forced execution.
