Some considerations on fiducie's definition in the Romanian civil code

Abstract

The New  Romanian Civil Code was the first piece of legislation that provided a definition of the fiducie.  Although it was possible to encounter said concept before 2011, no definition was offered by the law, prior to the New Civil Code.

This work is merely a starting point in the analysis of the device called “fiducie”. My study shall contain brief comments on fiducie’s legal definition. In a series of future articles, I intend to critically analyze fiducie’s legal definition, and the definitions highlighted by other authors.

For now, I shall take only a modest step: I will engage in a survey of the Romanian fiducie’s definition; also, I will force myself to approach the fiducie in a systemic manner.
