Some considerations on the concept of matrimonial convention and its object

Abstract

With the adoption of Law no. 287/2009 on the Civil Code, the Romanian legislator chose to reintroduce the matrimonial convention, making it possible for the spouses or future spouses to choose another matrimonial regime than the legal community. Since the legislature did not offer a stricto sensu definition (legal) of the matrimonial convention, in this article we intend to outline the concept of matrimonial convention and to delineate its specific object, without neglecting the aspects of comparative law by reporting to our legislation.
