Considerations regarding the moment of commission of corruption offences when perpretated by carrying out several alternative modalities
Abstract
Establishing the date of the commission of offences is necessary for the application of criminal law institutions. In judicial practice, there are difficulties in establishing the date of committing corruption offences when several alternative modalities are provided in the incriminating text. This article reviews doctrinal and jurisprudential opinions on the subject and presents the author's opinion on the form that corruption offenses can take, the date of the offense, and the consequences for the application of some criminal law institutions, such as the statute of limitation, amnesty or the application of criminal law in time.
