Sports violence
Abstract
The present study aims to realise an analysis of the acts of violence committed by athletes on the sports field from the criminal law perspective.
It’s generally accepted that in sports certain actions are allowed that would be illegal in other circumstances. Thus, sports violence that fits in normal limits of fair-play and sports rules don’t automatically attract the incidence of criminal liability. In this circumstances, some acts of sports violence are justified.
However, the doctrine couldn’t identify, unanimously, the judicial and legal excuse incident in the matter of sports violence, the authorization of law or the consent of the victim. According to this study, the thesis according to which the authorization of law represent the general judicial and legal excuse, could be accepted.
